Were you a recipient of American Recovery and Reinvestment Act
(ARRA) Funding for an infrastructure project? If so, please
beware that the United States Environmental Protection
Agency-Office of Inspector General, or their subcontractors, may be
auditing your project for compliance with the provisions of the
act. In particular, the audit will review whether the
equipment installed as part of the project meet the Buy America
provisions of the ARRA. Additionally, compliance with the
Davis-Bacon wage requirements will also be reviewed.
Not selected for an audit in 2011...your not out of the woods
yet! We strongly encourage you to begin gathering
documentation immediately as projects can be audited for up to
THREE years following
completion. Tracking down the required documentation is
tedious and penalties for not complying can be severe! Under
extreme circumstances, unfavorable findings may result in the
removal of equipment in question from the site or the requirement
to pay back a portion of the funds.
